Comprehensive Elder and Disability Law Services

As you age or become disabled, you are confronted with a wide range of legal issues that impact you, your adult children and other family members. You need someone in your corner to help you navigate these issues. Attorneys Pook and Jessica are dedicated to protecting the interests and rights of Minnesota elders and disabled individuals with issues such as:

  • Estate planning
  • Probate and Trust settlement
  • Drafting wills, trusts and disability trusts
  • Deeds and advanced directives
  • Accessing benefits through Medical Assistance (MA); Community Access for Disability Inclusion (CADI) Waiver Program; and Elderly Waiver (EW) Program; and other programs to pay for nursing home, assisted living, memory care, residential housing and rehabilitation care.
  • Establishing guardianships and conservatorships
  • Vulnerable adult exploitation
  • Housing transitions

Many of us will face at some point in our lives the need for long-term care. It may be for rehabilitation, or it could be for a longer period. We often hear our clients say, “I can’t take care of him/her any longer, but I also can’t afford to pay for care outside of the home.” We can help.

We help you prepare a plan to protect your assets when you or your loved one needs care in a nursing home, adult foster care, memory care, or an assisted living facility. We help you qualify for the right government benefit program: medical assistance, elderly waiver, CADI and others.  Some of these benefits even pay for care in your home.

We can help you and your loved one apply for and qualify for these benefits. There is a myriad of complex rules about the value of assets you and your spouse are allowed to own and still qualify for the benefits. We navigate these rules and counsel you on ownership of specific assets which allow you to qualify for the benefit and keep as many of your assets as possible. Some assets they do not “count.” Your home, as an example, can be entirely excluded under certain circumstances. Or a car and some life insurance policies are not counted.

The rules for eligibility change often. And navigation of these benefit waters is not for the unwary. We can guide the planning and application so that you can focus on the care and specific concerns of your loved one.

We at Grathwol Law have an intimate understanding of these issues because we have been through them many times before with many different families. We engage our wide-ranging legal knowledge backed by years of personal experience to guide you through the choppy waters to the safe harbor and peace of mind of having an effective and affordable plan in place. We take a warm-hearted, no-nonsense approach to frankly assessing the options available to you and your loved ones and finding innovative solutions to meet your needs while foregrounding asset preservation.
